McMillian Properties, a Robeson County manufactured home dealer, is banned from doing business, according to Attorney General Roy Cooper.
"Tricking consumers into paying for homes that aren't safe to live in is unfair and illegal," Cooper said in a news release issued Wednesday. "Homebuyers who were treated wrong now have a chance to get some money back, and I encourage any consumer who may be eligible for a refund to file a complaint with my office today."
McMillian Properties of Shannon and its managers, Bradley and Sherry McMillian, were barred from marketing, selling, financing, moving, setting up or repairing manufactured or modular homes through a consent judgement approved by Wake County Superior Court Judge Howard Manning, Cooper said.
If the defendants violate the court order, they will owe $100,000 in civil penalties.
Cooper filed suit in June 2012 against the McMillans for a variety of violations including taking consumers' money but failing to deliver homes as promised and selling damaged homes that were often uninhabitable.
Consumers who paid McMillian Properties for substandard homes or homes that never arrived now have an opportunity to get partial refunds as a result of the case, Cooper said.
The McMillians and their company owe $359,015 to consumers under the consent judgment but the state has not been able to collect any money from them.
McMillian Properties was required to post a bond in order to be licensed by the North Carolina Manufactured Housing Board. After the Board voted not to renew the McMillians' licenses, it agreed to let the bond company pay $35,000 in bond money to Cooper's office for refunds to consumers who paid money to the McMillians between June 2, 2011, and June 30, 2012, according to the release.
Consumers who did business with McMillian Properties during those dates and believe they did not get what they paid for are encouraged to file a complaint now, if they have not filed a complaint previously. Consumers can file a complaint online at www.ncdoj.gov or call 1-877-5-NO-SCAM to request a complaint form. Complaints must be received by June 7, 2013 to be considered for partial refunds as available.
A total of 52 consumers from the Robeson County area have previously filed complaints with the Attorney General's Office and other state agencies about McMillian Properties. Consumers who have previously filed complaints do not need to file an additional complaint to be eligible for a partial refund, according to Cooper's office.
