Man charged after 5-year-old shot and killed herself

Clinton McPhail has been charged with Unlawful Conduct toward a Minor after 5-year-old Sha'Diamond Graham shot and killed herself accidentally under his watch two weeks ago.

Deputies arrested him Monday afternoon at a home in Hartsville.

McPhail was watching Graham and her three other siblings at a home at the corner of Dunn and McFarland Streets in East Hartsville.

Captain Andy Locklair with the Darlington Sheriff's Office says the girl was playing with a gun when it fired.

Locklair adds McPhail was negligent in looking after the children and failed to secure the weapon so that it was out of reach of the kids. He says they had no other choice but to charge him.

Relatives say Graham was a happy little girl who they affectionately called Holla Box and Cookie Monster. They say she meant the world to their family.

McPhail faces up to 10 years in prison if convicted.

He is scheduled to go before a magistrate judge for a bond hearing later this evening.
