Agents with the State Law Enforcement Division charged Justin Brueger, 30, with Unlawful Conduct Toward a Child.
Brueger's son, Easton Brueger, was killed at a home on Fayetteville Avenue in Bennettsville Sunday night.
Brueger appeared in court Wednesday for an arraignment on the charges.
Officers say Brueger was cleaning his gun when it went off hitting the 8-year-old in the stomach. The boy died at the hospital.
The state police warrant says Brueger put his son at unreasonabl
risk of harm
in the unintentional shooting. It says he was cleaning his rifle and taking it apart and while the gun was pointed in the direction of his son.
"I want to say I'm very sorry to my son," said Brueger.
Judge Robert Stanton placed Brueger on a $10,000 personal recognizance bond. He also told Brueger that all weapons have to be removed from his home.
Brueger was also ordered to have no contact with his late son's mother and her family.
Easton Brueger is being laid to rest Wednesday afternoon.
