Hung jury on murder charge in trial of man accused of killing Dillon couple
Friday evening a Dillon County jury found Robert Lee Nelson guilty of Armed Robbery, Burglary First Degree and Weapons Possession, but the jury was hung on the murder charge.
Nelson was sentenced to 52 years in prison for the convictions. Circuit Judge Steven John will decide at a later time on how to approach the hung jury on the murder charge.
Jurors got the case at 3 p.m Thursday, but Judge John dismissed them 90 minutes later when the air conditioner went out in the jury room.
Nelson, 21, is accused of killing Walter Swaner, 84, and Mary Swaner, 80, in December of 2009.
Their bodies were found at their home on Dixie Acres drive in Dillon County.
The state had served Nelson with a notice of intent to seek the death penalty but withdrew it after he was declared intellectually disabled, but competent to stand trial.
